Production in paying quantities—PPQ, for short—is a notoriously fact-intensive issue. As a result, the resolution of PPQ cases through dispositive motion practice is rare. Short of settlement, trial is virtually inevitable, and there is substantial risk and uncertainty for everyone involved. These are among the reasons why mediation can be especially useful for resolving PPQ controversies.
